By downloading or using the NightCrawl mobile app or website ("the app"), operated by SDO Sports and Tech LLC ("we", "us"), you agree to these terms. If you do not agree, do not use the app.
NightCrawl is not an emergency service. Nothing in this app is a substitute for 911, official emergency alerts, or instructions from local authorities. Do not use it to make safety decisions. In an emergency, call 911.
NightCrawl is a directory and aggregator of publicly available police/fire scanner and severe-weather livestreams hosted on YouTube and Twitch, together with publicly published incident information. We do not host, produce, moderate or control any stream. All streams remain the property of their creators and platforms. NightCrawl is not affiliated with, sponsored by, or endorsed by any streamer, YouTube, Twitch, any law-enforcement agency, or any government body.
You must be at least 13 years old to use the app. The app surfaces real police, fire and severe-weather incident content, which some users may find distressing and which may be unsuitable for minors.
The Scanner Feed reproduces the LAPD "Calls for Service" dataset published by the City of Los Angeles as an open public record. You should understand that:
Live-status indicators, incident entries and typical-schedule estimates elsewhere in the app are likewise informational and may be delayed, incomplete or wrong.
The app and all content in it are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, timely, secure or error-free, or that any stream will be available — availability is controlled entirely by its creator and hosting platform and may end at any time.
You agree not to: disrupt or attempt to disrupt the service; scrape or automate access at abusive volume; attempt to gain unauthorised access to our systems; use the app to harass, stalk, or locate any individual; submit false, unlawful, infringing or abusive content through ratings, streamer suggestions or feedback; or use the app in violation of any applicable law or of YouTube's or Twitch's terms.
Ratings, streamer suggestions and feedback you submit are your responsibility. You grant us a non-exclusive, royalty-free licence to use them to operate and improve the app. We may remove any submission at our discretion.
NightCrawl links to third-party streams and displays platform-provided thumbnails and metadata. If you are a rights holder and believe material surfaced by the app infringes your rights, contact support@nightcrawl.app with a description of the work, the location in the app, and your contact details, and we will review and act promptly. If you are a streamer and would prefer not to be listed, tell us and we will remove you.
To the maximum extent permitted by law, SDO Sports and Tech LLC and its officers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury or property damage, arising out of or relating to your use of, or inability to use, the app or your reliance on any content in it — including scanner, incident or live-status information. Our total aggregate liability for any claim relating to the app will not exceed the greater of the amount you paid us in the twelve months before the claim (which, for a free app, is nothing) or USD $50.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless SDO Sports and Tech LLC from any claim or demand, including reasonable legal fees, arising from your misuse of the app or your violation of these terms or of any law or third-party right.
You may stop using the app at any time by uninstalling it. We may suspend or discontinue the app, or any part of it, at any time and without notice. We may block access for anyone who breaches these terms.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction, except that either party may seek relief in small-claims court.
If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
We may update these terms. The effective date above always reflects the current version, and continued use after a change constitutes acceptance.
